1. Nature of the Product

SwiftBot is a software application that automates trading strategies on the Deriv platform using artificial intelligence and neural networks. The software is provided as a tool for traders to automate their own trading activities. SwiftBot does not:

• Guarantee any profits or specific returns on investment
• Provide financial, investment, or trading advice
• Manage your funds or have access to withdraw your money
• Make promises about win rates, accuracy, or performance outcomes
• Act as your broker or intermediary with Deriv or any other platform

2. No Liability for Trading Losses

You acknowledge and agree that SwiftBot, its developers, distributors, and affiliates are NOT responsible for any financial losses you may incur. Trading in financial markets — including forex, synthetic indices, commodities, and cryptocurrencies — carries a high level of risk and may not be suitable for all investors. You can lose some or all of your invested capital.

By purchasing and using SwiftBot, you accept full responsibility for:

• All trading decisions made by the software on your behalf
• Any financial losses, damages, or negative outcomes
• Configuring the software parameters (stake size, risk level, instruments)
• Maintaining sufficient funds in your Deriv account
• Monitoring the software's performance and stopping it if needed

3. Risk Disclosure

Trading involves substantial risk of loss. Past performance — whether real or simulated — does not guarantee future results. The AI models used by SwiftBot are based on historical data analysis and probability calculations, which cannot predict future market conditions with certainty. Market conditions can change rapidly due to economic events, news, volatility spikes, and other unpredictable factors that may cause the software to make unprofitable trades.

Never trade with money you cannot afford to lose. You should only trade with risk capital — money that, if lost, would not affect your standard of living or financial obligations.

4. License & Usage

Each SwiftBot license key is locked to a single device. You may not:

• Share, resell, rent, or transfer your license key to another person
• Reverse engineer, decompile, or modify the software
• Use the software on multiple devices with a single license
• Distribute or sell copies of the software

Violation of these terms will result in immediate license revocation without refund.

5. Refund Policy

Due to the digital nature of the product and the immediate delivery of activation keys, all sales are final. Refunds are not provided except in cases where the software is proven to be non-functional due to a defect on our end, and we are unable to resolve the issue within 14 days of notification.

Refunds are NOT provided for:

• Trading losses incurred while using the software
• Failure to read or understand these terms before purchase
• Changes in your personal financial situation after purchase
• Dissatisfaction with trading results or performance
• Incompatibility with your device (system requirements are clearly stated)

6. Your Deriv Account

SwiftBot connects to your Deriv account via an API token that you generate yourself. We never have access to your Deriv password, account credentials, or funds. The API token you create grants specific permissions that you control. You are responsible for:

• Maintaining the security of your Deriv account and API token
• Understanding the permissions you grant to the API token
• Any activity that occurs through your Deriv account
• Complying with Deriv's own terms of service

7. No Warranties

SwiftBot is provided "AS IS" and "AS AVAILABLE" without warranties of any kind, either express or implied, including but not limited to warranties of merchantability, fitness for a particular purpose, non-infringement, or that the software will be error-free, uninterrupted, or produce any specific results. We do not warrant that the AI predictions or trading signals will be accurate or profitable.

8. Limitation of Liability

To the maximum extent permitted by law, SwiftBot, its developers, distributors, partners, and affiliates shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including but not limited to loss of profits, loss of capital, loss of data, business interruption, or any other damages arising out of or in connection with your use of or inability to use the software. Our total liability shall not exceed the amount you paid for the software license.

9. Indemnification

You agree to indemnify and hold harmless SwiftBot, its developers, distributors, and affiliates from any claims, damages, losses, liabilities, costs, and expenses (including legal fees) arising from your use of the software, your trading activities, your violation of these terms, or your violation of any third-party rights.

10. Acceptance of Terms

By purchasing SwiftBot, you confirm that:

• You have read and understood these Terms & Conditions in full
• You are at least 18 years of age and legally capable of entering into this agreement
• You understand that trading carries substantial risk of loss
• You accept full responsibility for all trading outcomes
• You agree that SwiftBot is not liable for any losses you may incur
• You are not relying on any promise or guarantee not contained in these terms

11. Changes to Terms

We reserve the right to modify these Terms & Conditions at any time. Changes become effective immediately upon posting on this page. Continued use of the software after changes constitutes acceptance of the updated terms.
